All credit/debit cards details and personally identifiable information will NOT be stored, sold, shared, rented or leased to any third parties. As described in detail below, any information we gather at this web site is strictly for our own use and is not shared with any other entity, public or private, for any reason. By placing an order you are offering to purchase a product/service on and subject to the following terms and conditions. All orders are subject to availability and confirmation of the order price. Dispatch times may vary according to availability and subject to any delays resulting from postal delays or force majeure for which we will not be responsible. Any purchase of typographic, photographic/visual content, any printing is the responsibility of the customer. The domain name is the responsibility of the customer. Each project includes a brief meeting, a presentation meeting and two correction round trips. Beyond that, a new quote will be sent to you. Transfer of reproduction rights and representation rights over a period of 5 years for digital and printed distribution limited to 5000 copies in a worldwide geographical area. Each invoice has to be paid within six months after the issue of the first project invoice.
Orders of product are processed promptly within 2-3 business days of your order. If we have any concerns or questions about your order, you will be notified immediately by the email you provided at checkout. Orders of services are processed within agreed timeline.
BOKCHOY Studio accepts payments by credit cards and bank transfer. Please be sure to provide your exact billing, shipping, and email address. Incorrect information may cause a delay in processing your order.
In all cases, the customer bears all money transfer fees and transfer costs including exchange rate.
When you place an order, you will receive an acknowledgement e-mail confirming receipt of your order: this email will only be an acknowledgement and will not constitute acceptance of your order. A contract between us will not be formed until we send you confirmation by e-mail that the goods which you ordered have been dispatched to you. Only those goods listed in the confirmation e-mail sent at the time of dispatch will be included in the contract formed.
Whilst we try and ensure that all details, descriptions and prices which appear on this Website are accurate, errors may occur. If we discover an error in the price of any goods which you have ordered we will inform you of this as soon as possible and give you the option of reconfirming your order at the correct price or cancelling it. If we are unable to contact you we will treat the order as cancelled. If you cancel and you have already paid for the goods, you will receive a full refund. Delivery costs will be charged in addition; such additional charges are clearly displayed where applicable and included in the ‘Total Cost’.
All projects with BOKCHOY Studio are structured with a 50% deposit payable at project commencement and a 50% final balance payable upon delivery, unless otherwise agreed in writing.
The initial 50% deposit is non-refundable and secures project scheduling, creative development, and allocated studio time.
Once the creative direction has been presented, reviewed, and approved, and execution has commenced, any decision by the client to pause, suspend, terminate, or discontinue the project shall not be considered a failure, error, or breach by BOKCHOY Studio, provided that the work delivered aligns with the approved creative direction and agreed scope.
The final 50% balance becomes immediately due upon delivery of the execution, regardless of whether the client chooses to proceed with further collaboration thereafter.
Creative dissatisfaction, change of preference, internal misalignment, budget constraints, or a decision to pursue an alternative direction do not constitute grounds for withholding, reducing, or delaying the final payment.
Requests to revisit, rethink, replace, or revise the approved creative direction after delivery are considered out of scope and do not suspend or affect payment obligations.
At BOKCHOY Studio’s sole discretion, a reduced settlement may be offered as a goodwill gesture. Any such adjustment must be agreed in writing and does not constitute an admission of fault, liability, or misalignment.
Termination of a project does not release the client from payment obligations for work delivered, work in progress, or reserved studio time.
Upon receiving your order, we carry out a standard authorization check on your payment card to ensure there are sufficient funds to fulfill the transaction. Your card will be debited upon authorization being received. The monies received upon the debiting of your card shall be treated as a deposit against the value of the goods you wish to purchase. Once the goods have been dispatched and you have been sent a confirmation email the monies paid as a deposit shall be used as consideration for the value of goods you have purchased as listed in the confirmation email. We accept payments online using Visa and MasterCard credit/debit card and PayPal in € or AED of the country the product is delivered to. If you make a payment for our products or services on our website, the details you are asked to submit will be provided directly to our payment provider via a secured connection. The cardholder must retain a copy of transaction records and Merchant policies and rules .
All orders are shipped from France. Upon shipping you will receive a confirmation email with the tracking number. BOKCHOY Studio is not responsible for delays in shipping or delivery errors due to force of nature or other uncontrollable events.
We offer shipping internationally if requested, however we are not responsible for customs costs or tax duties that may apply. We do our best to ship your goods out as quickly as we can, but please let us know if your order is required within a specific time frame.
You have the right to cancel the purchase of goods/services without having to give a reason at any time within the “cooling off period” of three working days, beginning on the day of the invoice If you are in possession of any goods you are under a duty to retain them and take reasonable care of them. You must send the goods back to us to our contact address at your own cost (unless we delivered the item to you in error or the item is damaged or defective) as soon as possible once you have cancelled the contract. For any services a fee of 2000 AED will be invoiced. We reserve the right to make a charge not exceeding our direct costs of recovering the goods if you do not return the goods or return them at our expense. Once you have notified us that you wish to cancel the contract, any sum debited to us will be refunded to you as soon as possible and in any event within 30 days of your cancellation. Refunds will be done only through the Original Mode of Payment.
BOKCHOY Studio provides creative, strategic, and design services based on information, objectives, constraints, and direction supplied by the client at the time of project initiation.
Any change in the client’s internal positioning, strategy, leadership, stakeholder priorities, market approach, regulatory considerations, public profile, or risk tolerance during the course of a project does not constitute a failure, error, or breach by BOKCHOY Studio.
BOKCHOY Studio shall not be held responsible for shifts in the client’s business, brand, or strategic direction that occur after project commencement, including but not limited to changes resulting from investor input, celebrity partnerships, legal concerns, public relations considerations, internal disagreement, or commercial risk reassessment.
BOKCHOY Studio provides creative and strategic services based on professional expertise, research, and experience. While every effort is made to deliver work of high quality and strategic value, BOKCHOY Studio does not guarantee commercial success, public reception, investor approval, internal alignment, emotional satisfaction, or market performance of any work delivered.
Creative work is inherently subjective. Disagreement, discomfort, or lack of internal consensus on the client’s side does not constitute grounds for non-payment, refund, revision beyond scope, or legal claim.
Any approval, whether written, verbal, implied, or demonstrated through continued collaboration, progression to execution, or lack of objection within a reasonable timeframe, shall be considered final and binding acceptance of the approved creative direction, strategy, or deliverables.
Once approval is granted, the client forfeits the right to claim misalignment, misunderstanding, or dissatisfaction based on subjective preference or subsequent internal change.
Change of Direction & Out-of-Scope Work
Any request to alter, replace, rethink, reframe, or reverse an approved creative direction, strategy, or execution shall be considered a change of scope.
Such changes may require:
– a revised timeline
– an additional fee
– a new contract or written agreement
BOKCHOY Studio is under no obligation to accommodate changes without written confirmation and updated compensation.
BOKCHOY Studio shall not be held liable for creative limitations, dilution, or compromise arising from undisclosed or evolving stakeholder sensitivities, legal concerns, brand reputation considerations, sponsorship obligations, or public-facing constraints.
It is the client’s responsibility to disclose all relevant limitations, sensitivities, and non-negotiables prior to project commencement.
All creative work, concepts, strategies, designs, and materials produced by BOKCHOY Studio remain the intellectual property of BOKCHOY Studio until full payment has been received.
Until full payment is made:
– no usage rights are granted
– no publication, distribution, reproduction, or implementation is permitted
– no internal or external presentation is allowed
Unauthorized use of unpaid work constitutes intellectual property infringement and may result in legal action.
Clients may not modify, adapt, fragment, or recontextualize BOKCHOY Studio’s work in a manner that misrepresents the original intent, strategy, or authorship.
BOKCHOY Studio reserves the right to publicly disassociate from work that has been altered, misused, or applied in a context that no longer reflects the approved direction.
All creative processes, strategic discussions, methodologies, internal documents, drafts, and exploratory materials shared during a project are confidential and may not be disclosed, shared, or used outside the scope of the agreed collaboration without prior written consent.
This includes internal decks, positioning documents, strategy drafts, and conceptual explorations.
Nothing in these Terms shall be construed as creating a partnership, joint venture, employment relationship, or fiduciary duty between BOKCHOY Studio and the client.
BOKCHOY Studio acts solely as an independent creative service provider.
To the fullest extent permitted by law, BOKCHOY Studio shall not be liable for any indirect, incidental, consequential, reputational, strategic, commercial, or financial damages arising from the use, interpretation, or implementation of its work.
This includes, but is not limited to:
– lost revenue
– investor rejection
– public criticism
– internal disagreement
– brand controversy
– regulatory or compliance outcomes
Good Faith Clause
Both parties agree to act in good faith throughout the collaboration. However, good faith does not require BOKCHOY Studio to revise completed work, waive fees, or absorb losses resulting from client indecision, internal conflict, or post-approval regret.
In the event of any dispute, ambiguity, or inconsistency, these Terms shall be interpreted in a manner that reasonably protects the creative, intellectual, and economic interests of BOKCHOY Studio.
We accept returns of unused and unopened product in its original packaging within 14 days of purchase. Please send an email to gabriela@bokchoy.studio with your order information, and we will contact you within four business days with further instructions on how to complete your return. Once we receive the returned item(s), the charges will be credited to your original method of payment excluding shipping costs. Shipping costs are non-refundable and all costs for return shipment are the responsibility of the customer.
